Terms and Conditions

1. Introduction
1.1 These Terms & Conditions (“Terms”) govern the relationship between Mondaire (“Mondaire”, “we”, “our”, or “us”) and the client (“you” or “your”) for the provision of itinerary design and related services.
1.2 By engaging Mondaire, you agree to these Terms in full. If you do not agree, you must not proceed with our services.
1.3 Please also review our Privacy Policy, Scope of Service, and Travel Insurance Advisory, which form part of these Terms.
2. Nature of Our Services
2.1 Mondaire is a bespoke travel consultancy. Our services include:
• 2.1.1 Providing travel planning and designing personalised itineraries tailored to client preferences; and
• 2.1.2 Assisting in coordinating reservations with selected suppliers (including securing provisional holds where possible).
2.2 Mondaire does not:
• 2.2.1 Sell flights or act as a flight booking agent;
• 2.2.2 Sell package holidays or operate as a tour operator;
• 2.2.3 Create or facilitate Linked Travel Arrangements as defined in the Package Travel and Linked Travel Arrangements Regulations 2018;
• 2.2.4 Provide ATOL, ABTA, or similar financial protection;
• 2.2.5 Hold client funds or make payments to suppliers on a client’s behalf.
2.3 All bookings and payments for travel services (including accommodation, experiences, and other third-party arrangements) are formed directly between the client and each supplier (see Clause 5). Mondaire’s fees for consultancy or itinerary planning are payable separately by the client in accordance with Clause 3.
2.4 Availability & Substitutions:
• 2.4.1 All experiences and accommodations listed in your itinerary are subject to availability at the time of booking. While Mondaire checks availability during the planning process, final confirmations are only made once you approve and complete bookings directly with suppliers. If any element becomes unavailable, Mondaire will recommend the best available alternative of equal or higher standard, subject to your review and approval.
3. Fees and Payment
3.1 Mondaire charges a design fee for itinerary planning and related advisory services. This fee does not cover the cost of accommodation, experiences, or supplier charges.
3.2 The design fee is payable in full upon confirmation of engagement and acceptance of these Terms. The fee is non- refundable under all circumstances.
3.3 Mondaire may, on occasion, receive commission from certain suppliers (e.g. hotels). This does not influence our recommendations, affect supplier pricing, or alter the design fee payable by you.
3.4 Payment Processing:
• 3.4.1 Mondaire uses the third-party payment processor Stripe to process card payments securely. Stripe is certified to PCI DSS Level 1, the highest standard of payment card security.
• 3.4.2 By engaging our services, you agree to Stripe’s Terms of Service and Privacy Policy. We recommend reviewing these documents before making any payments.
• 3.4.3 Mondaire has no responsibility or liability for Stripe’s services, including their terms or privacy practices.
• 3.4.4 All payment card information is processed and stored by Stripe in accordance with applicable security standards; Mondaire does not store full card details on its systems.
4. Flights
4.1 Mondaire does not book flights on your behalf.
4.2 We may, at our discretion, provide flight guidance, suggested routes, or links for your convenience. Such guidance is non-binding and does not constitute a booking service.
5. Supplier Contracts and Responsibilities
5.1 All contracts for travel arrangements, accommodation, dining, and experiences are formed directly between you and the supplier.
5.2 You are responsible for:
• 5.2.1 Reviewing and accepting all supplier terms and conditions;
• 5.2.2 Making timely payments directly to suppliers using your own payment method; and
• 5.2.3 Ensuring all personal and travel documentation is accurate and complete.
5.3 While Mondaire may assist by securing provisional holds or facilitating introductions, Mondaire is not a party to any supplier contract and accepts no liability for supplier performance, errors, or omissions.
6. Reservation Holds
6.1 Mondaire may secure provisional reservations with suppliers on your behalf prior to final confirmation.
6.2 Any such holds are non-binding and subject to supplier availability and terms.
6.3 You remain responsible for completing the booking and payment directly with the supplier.
7. Mondaire Work and Cancellation Policy
7.1 The design fee is non-refundable in all circumstances.
7.2 Feedback on the initial itinerary must be provided within 7 business days of delivery.
7.3 Lack of response beyond 14 business days will result in project closure. If the project is closed due to inactivity, the design fee will not be refunded.
7.4 All itineraries, recommendations, and related content created by Mondaire are for your personal use in connection with your trip and may not be shared, reproduced, or used for any commercial purpose. Mondaire retains full intellectual property rights over all content provided.
8. Supplier Amendments and Cancellations
8.1 Any amendments or cancellations to confirmed bookings are subject to the relevant supplier’s terms and conditions.
8.2 Mondaire accepts no liability for cancellation fees, penalties, or losses imposed by suppliers.
9. Travel Insurance
9.1 Mondaire does not sell or arrange travel insurance.
9.2 We strongly recommend you obtain comprehensive travel insurance prior to making any bookings.
9.3 Your insurance should include, but is not limited to, cover for:
• 9.3.1 Trip cancellation or curtailment;
• 9.3.2 Medical expenses and repatriation;
• 9.3.3 Supplier failure and travel disruption;
• 9.3.4 Loss, theft, or delay of baggage;
• 9.3.5 Personal liability.

10. Liability and Disclaimers
10.1 Mondaire acts solely as an advisory and facilitation service and is not responsible for:
• 10.1.1 Supplier performance, errors, or failures;
• 10.1.2 Documentation errors issued by suppliers;
• 10.1.3 Delays, cancellations, or disruptions caused by third parties.
10.2 Mondaire shall not be liable for any loss, damage, cost, or expense arising from:
• 10.2.1 Events beyond our reasonable control, including force majeure (natural disasters, strikes, pandemics, government restrictions, etc.);
• 10.2.2 Any act or omission by a supplier or client.
10.3 To the maximum extent permitted by law, Mondaire’s total liability shall not exceed the value of the design fee paid by you.
11. Client Responsibilities
11.1 You agree to:
• 11.1.1 Provide accurate and complete information to Mondaire;
• 11.1.2 Comply with passport, visa, and health requirements;
• 11.1.3 Arrange comprehensive travel insurance as per Clause 9.
12. Intellectual Property
12.1 All content, designs, branding, and materials provided by Mondaire remain our intellectual property and may not be copied, reproduced, or distributed for any purpose without prior written consent.
13. Privacy and Data
13.1 We process personal data in accordance with our Privacy Policy.
13.2 By engaging Mondaire, you consent to our use of your data as described in the Privacy Policy.
14. Governing Law
14.1 These Terms are governed by the laws of England and Wales.
14.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
